Invitation to apply for Capital Radio's broadcasting licence

The Independent Communications Authority of South Africa invites interested parties to apply for the Capital Radio commercial broadcasting licence to serve the eastern coastline of KwaZulu-Natal and the Eastern Cape.

1. Invitation to apply for a Commercial sound Broadcasting Licence - Capital Radio

Its assets - including studio equipment - are in the care of the Department of Communications which has put a price tag of R6 million to be paid by the successful broadcasting licence applicant. The licence is valid for a term of 6 years from the date of issue.

Capital Radio was one of the few private radio stations in the late 1970's that competed with the SABC radio portfolio in the eastern coastline of Kwa-Zulu-Natal and the Eastern cape. Capital Radio was funded by the Transkei homeland government, and shared offices with the defunct Transkei Broadcasting Corporation in Umtata, whereas its studios were located at the Durban beachfront.

With the transformation processes of state-owned broadcasting services in the mid-1990's, Capital Radio went off air and was closed down as a result of funding problems. Its assets were placed in the custody of the Department of Communications since then.

Applicants shall be responsible for the review and interpretation of the invitation, including all attachments. No liability shall accrue to the Authority if due to the applicant's failure to comply with such requirements, the application is rejected or disqualified by the Authority.

Each applicant shall be responsible for the assessment and analysis of the South African broadcasting market and the relevant regulatory environment. The Authority or its employees shall not be responsible for any disadvantage suffered by an applicant, prior to during or subsequent to the application process as a result of the inaccurate assessment and analysis of the South African broadcasting market or regulatory environment, or for any other reason whatsoever.

2. The Application process shall be conducted as follows:

  • Publication of Invitation - 10 September 2003
  • Closure for Submission of Applications - 09 December 2003
  • Public Hearing 1 March - 4 March 2004
  • Announcement / Gazetting ofDecision - 6 April 2004

    3. Application fee and other costs relating to the application

    3.1 All applications must be:

    3.1.1 accompanied by a written undertaking that the required bank guarantees for the payment of the R6 million to Government will be submitted to the Authority not later than 14 days prior to the date of the of the licence hearing and failure to comply with this requirement to the satisfaction of the Authority would render the application null and void;

    3.1.2 accompanied by a non-refundable application fee of R30 000;

    3.1.3 completed substantially in accordance with the information contravened and the particulars requested in the prescribed application form as well as the Position Paper on Private Sound Broadcasting Services obtainable from the Authority.

    3.2 Applicants shall bear the cost incurred in connection with the preparation and submission of the application. Regardless of the outcome of the application, applicants may under no circumstance claim reimbursement from the Authority of any costs related directly as indirectly to the application.

    3.3 Submission of the application

    3.3.1 The application, together with 16 certified copies thereof, will only be considered if lodged with the Authority not later than 16h00, South African time on or before 7 November 2003.
